Jet Ski Lease & Liability Waiver Agreement
Location: Captree State Park, New York

This Jet Ski Lease and Liability Waiver Agreement (“Agreement”) is made and entered into by and between Shore to Shore Jet Ski Tours (“Lessor”) and the undersigned customer (“Lessee”).

1. Lease Terms

• The lease begins at the scheduled Start Time and ends upon the safe return of the jet ski to Shore to Shore Jet Ski Tours at Captree State Park.
• The Lessee must be at least 18 years old and provide a valid government-issued photo ID.
• Only individuals approved by Shore to Shore Jet Ski Tours may operate the equipment.

2. Use of Equipment

• Lessee agrees to operate the jet ski safely and responsibly, following all instructions from staff.
• All riders and operators must wear U.S. Coast Guard-approved life jackets provided by Shore to Shore Jet Ski Tours.
• Mobile phone use is strictly prohibited while operating or riding a jet ski in motion. Phones may be used only when the jet ski is fully docked or turned off.
• Shore to Shore Jet Ski Tours is not liable for any lost, damaged, or water-damaged personal belongings, including mobile phones, sunglasses, cameras, or wallets.
• You will get wet. A bathing suit is recommended. Wearing shorts is highly recommended to help prevent seat rash. Sunscreen is also strongly encouraged.

3. Safety Regulations

• All operators must hold a valid driver’s license.
• Passengers must be at least 13 years old and accompanied by a licensed adult.
• Lessee agrees to watch the mandatory safety videos emailed upon booking and to follow all safety instructions from staff.
• Jet skis must be operated in accordance with all state and federal laws, including speed limits and no-wake zones.
• These skis have weight limit capacities. To ensure these vehicles’ safety and proper usage, riders must be less than 300 pounds to ride safely. 
• Operating under the influence of alcohol, drugs, or any intoxicating substance is strictly prohibited and will result in immediate lease termination without refund.

4. Acknowledgment of Risk

By signing below, I acknowledge and accept that:

• Operating or riding a jet ski involves inherent risks, including but not limited to: collisions, falls, equipment failure, weather hazards, drowning, or death.
• I am physically fit and medically able to participate.
• I voluntarily assume all risks associated with this activity for myself and any accompanying passengers.

5. Release of Liability & Indemnification

To the fullest extent permitted by law:

• I release and discharge Shore to Shore Jet Ski Tours, its owners, staff, agents, and affiliates from any liability for personal injury, death, property damage, or other loss incurred while using the equipment or participating in the tour.
• I agree to indemnify and hold harmless Shore to Shore Jet Ski Tours for any claims resulting from my conduct or that of my passengers.
• I understand that although no security deposit is required, I may be billed after the fact for any damages or loss resulting from misuse, negligence, or violation of this agreement.

6. Cancellation & Weather Policy

• Full refund is available for cancellations made at least 48 hours before the scheduled tour.
• 50% charge applies to cancellations made less than 48 hours in advance.
• No-shows or same-day cancellations will be charged the full rental cost.
• If Shore to Shore Jet Ski Tours deems weather conditions unsafe, the tour will be rescheduled or refunded at their discretion.

7. Photo/Video Release (Optional)

I grant permission for photos or videos taken during the activity to be used for promotional purposes by Shore to Shore Jet Ski Tours, unless I opt out in writing.

8. Binding Agreement

This agreement is binding upon me, my heirs, assigns, and legal representatives. I understand that by signing, I am waiving substantial legal rights.

Damage Fee Schedule (Minimum charges)

Note: A condition report will be reviewed and signed prior to departure.

I understand that by booking my tour I am acknowledging and accepting the terms and conditions for myself and my guest.
